How to Say... The way we talk matters a lot. The tone matters. The tenor matters. The words we use matter. Same thing when said in two different ways evokes two different emotions, relates to positivity or negativity. Wikipedia says Almeda awarded a degree to a dog. This is a gross understatement. This is cheating people. This is a crime - hiding information from the public is what I accuse Wikipedia of. For that reason, few postcards were produced privately because the privately printed postcards cost more to mail. However, on May 19, 1898, Congress passed the Private Mailing Card Act which allowed private printers and publishers to produce postcards. The Act required that private publishers print the message Private Mailing Cards, Authorized by Act of Congress on May 19, 1898 on the backs of their cards. Postage required was now a 1 cent stamp. Like Postal Cards, the Private Mailing Cards allowed only address information on the backs of the card. A little time spent this autumn will make your gardening and landscaping efforts easier and more enjoyable next spring! Lets start with the easy jobs - First remember to store all of your lawn and garden decor including fragile planters, gazing balls, and your deck furniture. Unglazed terra cotta planters left filled with soil outside will often break in the freezing temperatures so it is best to clean them and place them in a storage area where they are protected from the elements. Autumn is the time to find your birdfeeders and to start stocking your winter feeding pantry. Soon your many feathered friends will be flocking to your feeders for that nutritious morsel. Remember to keep your feeders full through the winter as the birds need reliable food sources through the winter months. Anyone in the world By Shelly Crawford Have you ever gone to your "weight loss" meeting and after the meeting made a b-line to a fast food restaurant with your fast food restaurant calorie book in tow? You know that you have a whole week before the next meeting ... plenty of time to still lose some weight. I've done that. You seem to have momentarily forgotten about your resolve to shed those pounds, once and for all. If you can relate to the above scenario in which I told myself a story about the trip to the fast food restaurant, perhaps you'll also relate to the three tricks below. In each case, I use a different trick to help me cope with the reality of the weigh-in. 1. Throw off Excess Baggage Have you ever gotten on the scale with all of your clothes on, shoes included, fearing that you may have gained some weight? Then you begin to gradually remove items. Your jacket, (yes, I had my jacket on), then your shoes, then socks, your pullover shirt, the next shirt, watch, earrings and necklace ... stepping on then stepping off the scale after each removal, noting the decrease in your weight each time? You're literally losing weight right before your very eyes. How wonderful! And after removing the last article of clothing allowable (so as not to be streaking in the house), you arrive at your true weight which somehow, even though you may have gained, doesn't come with quite the same blow as having to see it from the get go. Yes, I have done that. 2. Postpone the Weigh In Have you ever weighed yourself on a doctor's office type of scale and set it at the weight you were the last time you weighed? And when you step on the scale, if the weighing arm slams to the top of the gauge, you know you've gained. You get off, and go on about your business without knowing exactly how much you've gained. Heck, for all you know you may have just gained tenths of a pound. No big deal. You'll weigh again in a couple of days, after you've been more disciplined about sticking to your plan. Yes, I have done that. 3. Eliminate Waste How about this one ... Have you ever gotten up in the morning, jumped on the scale like experts suggest; stating that its the best time to weigh? You make a mental note of that weight then go get rid of all the "water" in your bladder from the night before, step on the scale, and lo and behold, you've lost nearly a pound! What a wonderful thing. Next, if you can, you make a "move" to "eliminate" anything heavier and you're off to a great start. As you know, watching your weight can be difficult. It truly is a journey. Along with your tried and true weight loss program, feel free to use a couple of these ideas to ease some of the pain from time to time along the way. Anyone in the world By Lance Winslow A franchisee of the franchise system must maintain their financial records, business records and reports in compliance with the confidential operations manual set forth by the franchisor. Each franchisor must make sure that the guidelines for the books, accounting system and business records are understandable and gone over in training. Additionally it would be recommended that such issues were addressed into franchising agreements prior to the commencement of the franchised outlet. In my franchising company I had inserted a clause to address this very issue. Below you will find the clause that I came up with that became part of every franchise agreement that our company signed; 3.17.1 Maintenance of Books; Reports Franchisee must maintain full and complete records of all business done and revenue Franchisee receives through the Franchised Business in accordance with generally accepted accounting principles employed in the Marketing Area or the United States and the standards and Confidential Operations Manual provided by Franchisor. These records will include, but are not limited to, order sheets, sales agreement forms, daily sales summaries, tax returns, financial statements, and invoices. Franchisee will date, file in consecutive order, retain for a period of five years, and make available to Franchisor for inspection and audit all of Franchisees records. Franchisee, if a natural person or persons, will submit to Franchisor a list of all owners of the Franchise Business and the respective interests held by each as of the end of each fiscal year. Franchisee, if a partnership, will submit to Franchisor a list of all partners and the respective interests in Franchisee held by each partner as of the end of each fiscal year. Franchisee, if a limited liability company, will submit to Franchisor a list of all members and the respective interests in Franchisee held by each member as of the end of each fiscal year. Franchisee, if a corporation, will submit to Franchisor a list of all shareholders and the respective interests in Franchisee held by each shareholder as of the end of each fiscal year (provided, however, if Franchisees shares are publicly traded, the list of shareholders required will include only those owning five percent or more of the shares outstanding). The required report will be submitted to Franchisor within ninety (90) calendar days after the end of Franchisors fiscal year. Franchisee will furnish Franchisor with unaudited financial statements for the Franchised Business within ninety (90) calendar days of the end of each calendar year signed by the Franchisee, if the Franchisee is an individual, or the majority partner, shareholder or member of the Franchisee if the Franchisee is a partnership, corporation or limited liability company, which shall include an income statement and balance sheet. If Franchisee is a division of a corporation, then the financial statements need only relate to the operations of such division. These statements must be prepared following generally accepted accounting principles. --- --- --- --- --- --- --- Since this issue is so vitally important to the franchised business model to maintain consistency in control of the franchise system, each franchisor would be well advised to contact the franchising attorney who specializes in franchise systems.
